Privacy statement GOPACS website
This is a translation of the Dutch version of the GOPACS Privacy Statement. If there are inconsistencies, contradictions, differences or interpretation discussions between language versions, the original Dutch version of this document will prevail.
1. What is GOPACS?
The Dutch Grid operators are working together on the Grid Operators Platform for Congestion Solutions via a foundation called Stichting GOPACS (hereinafter: GOPACS).
The grid operators of the electricity network in the Netherlands have the statutory duty to ensure that there is a sufficient supply of energy at the right time and in the right place. GOPACS is an important step towards reducing capacity shortages (congestion) in the electricity network and so to contribute to keeping the Dutch electricity network reliable and affordable.
If you visit this website, GOPACS may process your data, for example data you have provided via questionnaires or elsewhere on the website. GOPACS guarantees and respects your privacy when it processes your data, for example by complying with the General Data Protection Regulation.
Because the protection of your personal data is very important to us, we want to inform you about the processing of your personal data in this privacy statement. The privacy statement on our website is regularly checked and, if necessary, updated. The latest version of our privacy statement can always be found on this website.

2. Processing of personal data
We process personal data on our website. Personal data is data that allow us to identify a natural person. Identification can be directly, for example based on a first and last name, or indirectly by combining several data, for example a first name and a telephone number.
Which of your personal data we process on our website depends on which service(s) you use. For example the contact form or the newsletter. These processing activities are explained in the following chapters. In all cases, we process a minimum number of personal data via our cookies. You will find more information about our use of cookies in the next chapter.
3. Cookies
When you visit our website, small text files (so-called cookies) can be placed in your browser. Cookies allow us to remember your personal settings for the next time you visit our website. We use essential cookies on our website and cookies to display external content.

3.2. Cookies for external content
On our website we are responsible for the content of cookies placed by our website itself. For the responsibility for external cookies, such as Clicky and YouTube, we refer to the privacy statements of the relevant suppliers.
If you consent to the use of external content integrated into our website, your personal data will be shared automatically with websites of third parties. This is only done if you have activated the relevant cookie and have expressly consented to it. Specifically, this concerns the following cookies and providers:

4. If you use our contact form
Depending on which fields of the contact form you have filled in, you provide the following personal data to us:
first name, surname, fixed/mobile phone number, email address and other contact and correspondence details
5. Origin/source of your data
We receive your personal data directly from you. GOPACS does not receive or purchase personal data from third parties for use of the website.
6. Basis for processing your personal data
We process your personal data in accordance with the General Data Protection Regulation (GDPR).
For essential cookies, we collect your personal data on the basis of a legitimate interest, as described in Article 6 (1) (f) of the GDPR.
If you have given your consent, we will collect your personal data in accordance with Article 6 (1) (a) of the GDPR. We do so if:
- you consent to the use of non-essential cookies;
- you contact us by e-mail or via the contact form.
7. Who has access to your personal data?
Our employees have access to your data to the extent this is necessary to achieve the above purposes.
We use external suppliers to process your personal data within the framework of our business purposes and our communication. These are mainly IT and network suppliers, email processors, file/data destruction suppliers, providers of archiving services as well as agencies/service providers that support our (business) communication. These service providers are subject to strict contractual agreements such as confidentiality agreements, data protection statements and contracts.
If you consent to cookies for external content, your personal data may be transferred to the providers and suppliers described above.
8. Your rights as a data subject
As a data subject the General Data Protection Regulation (GDPR) gives you several rights. To exercise your rights as a data subject, please contact us at privacy@gopacs.eu.
If you exercise your rights as a data subject, we may ask you to identify yourself before we answer your question(s).
As a data subject within the meaning of the GDPR, you have the following rights:
- Right to access your data (Article16) and if you find that your data is incorrect or incomplete, you may request that your data be changed or supplemented.
- Under certain legal conditions, you have the right to have your data deleted (Article 17), the right to restriction of processing (Article 18), the right to data portability (Article 20), and the right to object (Article21).
- You have the right to file a complaint with a supervisory authority (Article 77).
The supervisory authority in the Netherlands is the Autoriteit Persoonsgegevens, Bezuidenhoutseweg 30, 2594 AV DEN HAAG.
You may at any time withdraw your consent for the processing of your personal data and request that your personal data processed be deleted. If you withdraw your consent, the processing of your personal data remains lawful until the time of withdrawal. Your personal data can only be deleted if there is no other legal basis for the processing of your personal data. If you wish to withdraw your consent, please send your request to privacy@gopacs.eu.
